Tip for first class: Think about the circumstances under which a person
should be held responsible for injuries she causes to another. Note that, in
Cohen, the trial court “took the case from the jury” and the plaintiff was not
allowed to recover, whereas the plaintiff in Spano was given the chance to
recover. What accounts for the different results reached in those two cases? Do
you agree with the decisions reached by the two courts?
